Please read this User Agreement carefully before using our services.
XXKK is a platform where users can trade digital assets and access related services (hereinafter referred to as the "Services" or "Service"). For convenience, in this Agreement, the company and the platform are collectively referred to as "we" or other first-person pronouns. Similarly, any natural person or entity accessing the platform is referred to as "you" or other second-person pronouns. For clarity, we and you are collectively referred to as "the Parties," and individually as "a Party." All content on the platform is provided for user convenience and may be offered in multiple languages. In case of any conflict or omission, the English version shall prevail.
Important Notice:
We hereby remind you:
1. Digital assets themselves are not provided by any financial institution, company, or the platform.
2. The digital asset market is new and unproven and may not necessarily develop robustly.
3. Digital assets are primarily used by speculators and are relatively limited in retail and commercial use; trading digital assets carries high risk as they are traded 24/7, prices fluctuate without limits, and market makers and global government policies may cause significant price volatility.
4. If the platform believes that you have violated this Agreement or any applicable regulations, or that using our services is illegal in your jurisdiction, the platform may suspend or terminate your account, services, or any digital asset transactions at any time.
Trading digital assets carries significant risk and is not suitable for most people. You acknowledge and understand that investing in digital assets may result in partial or total loss of your investment, and therefore it is recommended that you decide your investment amount based on your own risk tolerance. You acknowledge and understand that digital assets may carry derivative risks. Therefore, if you have any doubts, it is recommended to seek assistance from a financial advisor. In addition to the risks above, unpredictable risks may also exist. Therefore, before deciding to buy or sell digital assets, please carefully consider your financial condition and related risks. All resulting losses are borne by you, and we assume no responsibility. Specifically, we notify you that:
1. You understand that the platform serves only as a venue for obtaining information on digital assets, finding trading counterparts, and conducting negotiations and transactions. We do not participate in any of your transactions. You are responsible for evaluating the authenticity, legality, and validity of any digital asset and/or information and bear all associated responsibilities and losses.
2. All opinions, information, discussions, analyses, prices, suggestions, and other information on the platform are general market commentary and do not constitute any investment advice. We do not assume responsibility for any direct or indirect loss arising from reliance on such information, including but not limited to lost profits.
3. Platform content may change at any time without notice. We have taken reasonable measures to ensure the accuracy of information on the platform, but we do not guarantee, and cannot guarantee, the degree of accuracy. We are not responsible for any direct or indirect loss caused by platform information, nor for losses due to internet connectivity, transmission, delays, or notifications.
4. Using internet-based trading systems involves risks, including but not limited to software, hardware, or internet connection failures. Since we cannot control the reliability and availability of the internet, we are not responsible for any distortion, delay, or connection failure.
5. XXKK.com is the sole official public information platform of XXKK.
6. Any use of the platform for illegal trading activities, such as money laundering, smuggling, or commercial bribery, is prohibited. If such activities are discovered, the platform will take all available measures, including freezing accounts and notifying authorities. We assume no responsibility for this and reserve the right to pursue liabilities of involved parties.
7. Market manipulation, improper trading, or any other illegal trading activities using the platform are prohibited. If discovered, the platform may take preventive and protective measures such as warnings, transaction restrictions, or account closures. We assume no responsibility and reserve the right to pursue liabilities.
General Provisions
1. The User Agreement (hereinafter referred to as "this Agreement" or "these Terms and Conditions") consists of the main body, privacy policy, Know Your Customer (KYC) and Anti-Money Laundering (AML) policies, and any rules, statements, or notices published or to be published by the platform.
2. Before using the services provided by the platform, you should read this Agreement carefully and consult a professional lawyer if necessary. If you do not agree to the terms and conditions of this Agreement or any amendments thereto, you must immediately stop using the services or logging into the platform. Logging in or using any platform service constitutes your full understanding and acceptance of all terms, including any modifications.
3. Upon filling in relevant information and completing the registration, you become a platform member ("Member"). Clicking "I Agree" is deemed your electronic signature agreement. Using the "I Agree" button or any other permitted method constitutes full acceptance of all terms, regardless of the lack of a handwritten signature.
4. After becoming a member, you will receive an account and password and are responsible for all activities conducted via your account.
5. Only members can trade digital assets on the platform and access member-exclusive services. Non-members may browse the platform and access other permitted services.
6. By registering and using any platform services, you acknowledge that you have read and understood this Agreement and:
6-1. Accept all terms and conditions of this Agreement.
6-2. Confirm you are at least 18 years old or have the legal capacity under applicable law to enter into a contract and that your platform use complies with laws of your jurisdiction. You confirm your ability to trade digital assets under these terms.
6-3. You represent that all digital assets involved in transactions under this Agreement are legally obtained and owned by you.
6-4. You agree to assume all responsibility for your transactions, non-transaction activities, and any resulting profits or losses.
6-5. You confirm that information provided during registration is true and accurate.
6-6. You agree to comply with all applicable laws, including reporting trading profits for tax purposes.
6-7. This Agreement only governs rights and obligations between you and us and does not involve disputes between platform users or with other websites.
Amendments
We reserve the right to modify this Agreement at any time and publish such modifications on the website. The effective date will be indicated on the front page of the modified Agreement. The modified Agreement takes effect immediately upon announcement. You should regularly check the platform for changes. Continuing to use the services constitutes acceptance of the modified Agreement.
Registration
Eligibility
You confirm and undertake that upon completing registration or using platform services, you have the legal capacity to do so. Clicking the registration button signifies your or your authorized agent's agreement to this Agreement. If you lack such capacity, you and your agent bear all consequences. The platform reserves the right to cancel or freeze accounts and pursue liabilities.
You also declare that you are not on any FATF, OFAC, UN Security Council, or other sanctions lists. We reserve the right to choose operating markets and jurisdictions and may restrict or deny services to certain countries.
Purpose of Registration
You confirm and undertake not to register for purposes violating laws or disrupting platform trading order.
Registration Process
1. You agree to provide a valid email, phone number, or other permitted information. You may log in using email, phone, or other allowed methods. You must provide true information and update it to ensure accuracy.
2. If real-name verification is required by local law for phone numbers, you must ensure compliance. Any resulting loss is your responsibility.
3. Upon providing valid information and verification, you will receive an account and password and become a registered member.
4. You agree to receive platform management and operation-related emails and/or SMS messages.
5. Verified merchants must provide additional registration materials. A portion of digital assets will be locked as margin. The platform may use the margin to cover third-party losses if the merchant refuses payment. Verified merchant badges will distinguish verified from unverified merchants. Cancellation requests will be processed within three business days if there are no unresolved disputes or negative history.
Services
The platform provides online trading services for digital assets. We do not act as buyer or seller, nor provide fiat deposit or withdrawal services.
Service Content
1. You may view real-time digital asset quotes and trading information, submit transaction instructions, and complete trades.
2. You may view your account information and use platform functions.
3. You may participate in platform-organized activities per posted rules.
4. Additional services as promised by the platform.
Service Rules
You agree to comply with the following service rules:
1. Comply with applicable laws and ensure the legality of all digital assets; do not engage in illegal activities or harm the platform or third parties.
2. Safeguard your account credentials, financial passwords, and verification codes. Notify the platform immediately of unauthorized use. Unauthorized transfer of accounts is prohibited.
3. You are responsible for all activities conducted with your account and password.
4. You must not disrupt normal trading or interfere with other users or the platform's operation.
5. You may not demand information via non-legal channels in disputes with other users.
6. All taxes and service fees are your responsibility.
7. You must comply with this Agreement and other posted rules; you may terminate services at any time.
Product Rules
Trading Rules
You agree to comply with the following when trading:
1. Browse trading information carefully before trading.
2. Pay transaction commission; payment authorizes the platform to provide brokerage services, and matching is automatic.
3. View transaction details in the management center.
4. You may revoke or modify commission before transaction completion.
Platform Rights and Obligations
1. The platform may refuse registration if eligibility is not met and may cancel accounts. Other rights to accept registration remain reserved.
2. Platform may suspend or terminate access if account user is not original registrant.
3. Platform may request updates or corrections if information is inaccurate or incomplete.
4. Platform may correct any displayed errors.
5. Platform may modify, suspend, or terminate services at any time without notice.
6. Platform shall provide necessary technical and management measures to maintain operations.
7. Accounts inactive for one year may be revoked.
8. Platform shall implement technical and security measures for asset safety.
9. Platform may delete content violating laws or rules without notice.
10. Platform may request additional information per jurisdictional law and take necessary measures; you must cooperate.
Indemnification
1. Liability for direct damage is capped at total trading fees paid in the past three months.
2. Violations require payment of at least $2,000,000 and associated costs.
Right to Injunctive Relief
Parties acknowledge that legal remedies may be insufficient; non-breaching party may seek injunctions and other remedies.
Liability Limitation and Exemption
1. We are not liable for:
1-1. Loss of income
1-2. Loss of trading profit or contracts
1-3. Business interruption
1-4. Expected currency loss
1-5. Information loss
1-6. Lost opportunities, reputational damage
1-7. Data damage or loss
1-8. Cost of replacement products or services
1-9. Any indirect, special, or incidental damages regardless of foreseeability
1-10. Items 1-9 are independent.
2. We are not liable for damages caused by:
2-1. Reasonable suspicion of illegal transactions
2-2. Suspicion of illegal or unethical behavior on the platform
2-3. Fees or losses from services, data, or transactions
2-4. Misunderstandings of services
2-5. Other losses not attributable to us
3. Platform is not responsible for failures due to uncontrollable events or third parties.
4. Platform cannot guarantee immunity from viruses or malware; all risks are borne by you.
5. No guarantee for third-party websites linked to the platform.
6. Services are provided without explicit or implicit warranties; digital asset market risks are borne by you.
7. These warranties and commitments replace all other warranties, written or oral.
8. We do not waive any rights not mentioned and limit liability to the maximum extent permitted.
9. Registration implies approval of all platform operations and assumption of related risks.
Termination
1. Platform may cancel your account; Agreement terminates upon cancellation.
2. Platform may terminate all services; Agreement terminates upon termination.
3. Termination does not entitle you to request continued services or disclosure of previous account information.
4. Termination does not affect other liabilities of the breaching party.
Intellectual Property
1. All intellectual property on the platform, including logos, databases, designs, text, graphics, software, photos, videos, music, sounds, and related materials, is owned by the platform. Commercial use, copying, modification, or transmission is prohibited.
2. All rights in the platform name, including trademarks, are owned by the platform.
3. By accepting this Agreement, you voluntarily transfer all copyright of any content you publish on the platform to the platform, including but not limited to reproduction, distribution, rental, exhibition, performance, broadcasting, network transmission, filming, adaptation, translation, compilation, and other transferable rights.
4. During service use, you shall not illegally use or dispose of intellectual property of the platform or others.
5. Logging in or using services does not transfer any IP rights to you.
Calculations
All transactions are verified by the platform; calculation methods are posted, but interference or errors may occur.
Export Control
You agree not to export, re-export, import, or transfer any platform materials in violation of applicable laws and will report any violations.
Assignment
Rights and obligations under this Agreement are binding on successors and assignees. You may not assign your rights or obligations without consent; we may assign our rights and obligations with 30 days’ notice.
Severability
If any provision is invalid, the remainder remains effective.
No Agency
This Agreement does not create any agency, trust, or representation relationship.
Waiver
Failure to exercise rights does not waive other rights or remedies.
Headings
Headings are for convenience only and do not affect interpretation.
Effect and Interpretation
1. This Agreement is effective upon account registration and is binding.
2. Final interpretation belongs to the platform.
Our assets are 100% fully backed; we do not use any assets to earn interest.
Agent Rules:
• Any behavior of inviting registered users or fraud determined by XXKK as unrecognized will result in disqualification and commission adjustment to 0.
• Any private high-commission behavior determined as unrecognized will result in disqualification and commission adjustment to 0.
• Confusing XXKK pages with phishing sites is prohibited; violation results in disqualification and commission adjustment to 0.
• Do not impersonate XXKK for misleading statements, including keywords promotion; violators will lose rewards and promotion qualification.
• Any behavior damaging or defaming XXKK may result in disqualification and commission adjustment to 0, and platform may reclaim commissions and pursue damages, including:
1. Posting false information or negative reviews on social media such as Facebook, Instagram, Twitter
2. Organizing users to make financial claims against XXKK.
